Time/Volume rates in this Tariff shall be as specified in individual commodity descriptions and TLI's referenced as Time/Volume rates in accordance with 46 C.F.R. Sections 514.13 (a)(2)(ii) and 514.13 (b)(19) (i), subject to the terms and conditions below. 1. Enrollment: Shippers/Consignees desiring to ship cargo under this offering should notify the carrier in writing. This enrollment must be in the name of the Shipper or Consignee making the application. 2. Requirements: If less than the minimum volume specified in Time/Volume rates in this Tariff has been shipped by the end of the offering period, then all cargo shipped shall be rerated at rates contained elsewhere in this Tariff. 3. General Conditions: a. The shipment records which will be maintained to support the Time/Volume rate are the written notification of enrollment and the Bills of Lading. b. Shippers/Consignees accepting this offering will be assigned a TVR number which shall be referenced on each Bill of Lading under this Time Volume rate offer. Any Shipment which does not bear the TVR number on the Bill of lading shall not be used to satisfy any requirement of this offering. c. Once a Time/Volume Rate is accepted by one shipper, it shall remain in effect for the time specified, without amendment. d. Shipper notices and shipment records supporting a Time/Volume Rate will be maintained by the Carrier for five years after any shipper's use of a Time/Volume Rate has ended. Bills of Lading shall constitute shipment records.
