        damages arising from its transportation-

        penalties assessed pursuant to the Shipping Act
        of 1984, as modified by The Ocean Shipping Reform
        Act of 1998.

    1.  Carrier's legal agent for the service of judicial

        instance in which the designated legal agent
        cannot be served because of death, disability or
        unavailability, the Secretary, Federal Maritime
        Commission will be deemed to be the Carrier's
        legal agent for service of process.

    2.  Service of administrative process, other than
        subpoenas, may be affected upon the legal agent
        by mailing a copy of the documents to be served
        by certified or registered mail, return receipt
        requested.
