1. All rates and charges herein apply on vehicles and
other uncontainerized cargo in roll-on/roll-off
vessels. Berth terms apply unless otherwise specified.
2. Except as otherwise provided herein, rates and
charges published in this Tariff are stated in terms
of U.S. Currency and apply per 1,000 Kilos (W) or
1 Cubic Meter (M), as indicated, whichever yields the
greater revenue. Where the word "Weight" or the letter
"W" appears next to an article or commodity, weight
rates are applicable without regard to measurement.
Where the word "Measurement" or the letter "M" appears
next to an article or commodity, measurement rates are
applicable without regard to weight. Rates prefixed by
the abbreviation "EA" or "LS" are Lump Sum rates and
apply to each unit of cargo (e.g., each vehicle)
shipped.
3. All cargo loaded on deck is carried at cargo
owner's risk.
4. Rates shown herein do NOT include insurance and no
premium for account of Shipper may be absorbed by the
Carrier.
5. For cargo that is located at Ports or Terminals where
Port Authorities or terminal Operators publish and
assess services and facilities charges, such charges
will be assessed by the carrier against the cargo.
The charges must be shown on the Bill of lading and
must be prepaid.
6. The rates set forth in this Tariff apply to the
transportation of all cargo in common carriage
transported by the Carrier to the Ports covered
hereunder. No rate quotation by any officer, agent,
or employee of the Carrier, whether made verbally or
in writing is valid except insofar as that quotation
reflects the rates set forth herein applicable at the
time of shipment.
7. Packages of miscellaneous articles shall be rated on
the basis of the highest rated article in the package,
with the exception of advertising matter when shipped
in the same package with the commodity it advertises.
8. Description of commodities on all copies of Bills of
Lading, which shall be verified by a comparison with
the Custom House Declaration, shall determine the
rates to be applied. Supplementary guarantees of any
kind shall not be sufficient to warrant application
of rate other than that required by description on
Bills of Lading.
9. Rates shown herein do NOT apply on cargo in Bulk NOT
subject to mark and count, unless otherwise specified.
10. FORCE MAJEURE CLAUSE: Without prejudice to any rights
or privileges of the Carrier's under covering Bills
of Lading, Dock Receipts, or Booking Contracts, or
under applicable provisions of law, in the event
of war, hostilities, warlike operations, embargoes,
blockades, port congestion, strikes or labor
disturbances, regulations of any governmental
authority pertaining thereto or any other official
interferences with commercial intercourse arising
from the above conditions and affecting the Carrier's
operations, the Carrier reserves the right to cancel
any outstanding booking or contract if in conformity
with the Federal Maritime Commission Regulations by
publication in this Tariff, any affected rate or
rates in order to meet such conditions."
11. Attachments/Parts moving with the main roro unit are
freighted on the same base ocean rate. Attachments/Parts
not accompanying the main roro unit are freighted in
accordance with the cargoes description (Applicable on
cargo moving to/from Argentina, Brazil, Chile, Colombia,
Costa Rica, Dominican Republic, Ecuador, Guatemala,
Haiti, Honduras, Mexico, Netherlands Antilles, Panama,
Paraguay, Peru, The Bahamas, Uruguay and Venezuela
only).
12. If cargo requires specialized/additional equipment
(ie. Crane) to receive cargo from the first mode of
transport (truck/train/barge, etc.) the equipment and
labor arrangements are the responsibility and for the
account of the cargo (Applicable on cargo moving to
Argentina, Brazil, Chile, Colombia, Costa Rica,
Dominican Republic, Ecuador, Guatemala, Haiti, Honduras,
Mexico, Netherlands Antilles, Panama, Paraguay, Peru,
The Bahamas, Uruguay and Venezuela only).
