Compensation will be paid only to independent Ocean
Freight Forwarders, licensed under Section 19(a) of the
Shipping Act of 1984 and the rules and regulations
promulgated pursuant to it, and only when such a
forwarder certifies in writing, as specified in these
rules and regulations, that it is so licensed and that it
has complied with all the requirements of such Act and
such rules and regulations.  The compensation which is
paid under this rule shall be on the gross freight.  The
gross freight includes the tariff rate and Heavy Lift and
Extra Length Charges, if applicable, but shall not, for
the purpose of computing compensation, include charges
assessed for containerization of cargo, container rental
fee, war risk compensation, port surcharges, port detention
charges, demurrage, bunker surcharges, port arbitraries,
harbor dues or any other charge or surcharge designated
to cover specific costs.  Compensation will not be paid
on any shipment on which brokerage is payable.
 
When compensation is to be paid to a licensed Ocean
Freight Forwarder who is also a licensed Customs House
Broker, a commission as shown below will be paid on the
aggregate of all rates and charges to be paid by the
Shipper or the Consignee under the tariff.  Bills of
Lading submitted by such forwarders must show their
Customs House Brokers and FMC license numbers.
 
Brokerage or compensation will be allowed to an Ocean
Freight Forwarder or Freight Broker only on shipments
where the name of the actual Shipper is disclosed on the
shipper identification line appearing above the cargo
description data of the ocean bill of lading, and, if
the forwarder's name also appears on said Shipper
identification line, it appears after the name of the
actual Shipper and designated "as Agents" or "Agent".
 
Compensation and/or Brokerage may not be deducted from
ocean freight and other charges due in accordance with
the rates and conditions contained in this tariff.
 
Compensation will be paid to non-U.S. entities making cargo
available to the Carrier for shipments from the U.S.
Compensation to be paid as per RATES OF COMPENSATION list
in same section.
 
RATES OF COMPENSATION:
 
Compensation will be paid as follows:
 
       2.50% on all shipments (See Exceptions)
 
 EXCEPTIONS:
 
 1) 1.25% on all Auto Manufacturers cargo
 
 2) If a licensed Freight Forwarder is not involved with
    the shipment, then brokerage commission can be paid
    up to 10% of cargo value upon the discretion of
    Carrier.
 
 3) $70.00 per unit on pov cars/vans/suvs/light duty
    trucks not exceeding 2.4 meters in height destined to
    Countries in the Middle East and Africa
 
 4) 3.0% on all other High Heavy Cargoes, Rolling Stock,
    Static destined to Countries in the Middle East and
    Africa
