At the request of shipper or consignee, carrier, at its option, may discharge deliver cargo at a port other than that stated in the Bill of Lading. Shipper or consignee must submit such diverson request to carrier forty-eight (48) hours, exclusive of Saturdays, Sundays and holidays, prior to vessel's arrival at the port of discharge (either the port on the Bill of Lading or the port to which diverted, whichever is earlier). When carrier grants such request for diversion, actual shifting expense, subject to a minimum of USD15.00 per ton as freighted, is for the account of cargo. When the requested diversion changes only place of delivery but does not change discharge port, no shifting expenses are incurred or billed. Freight and charges are adjusted to be those in effect to the diverted destination. A reprint charge of USD 100 per Bill of Lading is assessed when request for diversion occurs after the carrier has printed the Bill of Lading. Adjusted freight and charges, the reprint charge and shifting expense must be paid in accordance with the terms of Rule 7.
